Statutory training is the training usually required by law or where a statutory body has instructed an organisation to provide training on the basis of specific legislation, e.g. the Health and Safety at Work Act 1974 and the Management of Health and Safety at Work Regulations 1999.
Care homes often describe this as ‘essential training’ or ‘compulsory training’. Statutory training ensures that care home staff have the knowledge to maintain a healthy and safe working environment for themselves, their colleagues and residents within the care home setting.
In general, mandatory training is the training that a care home determines as essential for safe and efficient practice and in order to reduce organisational risks and comply with policies, government guidelines and regulations.
Statutory training is required to ensure that the care home is meeting any legislative duties. Mandatory training is an organisational requirement to limit risk and maintain a safe working practice. Each care home has a responsibility to provide various statutory and mandatory training and to ensure that all care home staff attend or complete appropriate training courses.
Care home mandatory training is the training that adult social care providers provide their staff to meet both statutory and regulatory requirements, including the Health and Safety at Work Act 1974, local authority requirements, service commissioners’ requirements and any other directives from the Care Quality Commission.
Under the Health and Safety at Work Act, all care organisations have a legal responsibility to provide care staff with health and safety awareness training, including risk assessments and fire safety. Other mandatory training courses for care staff include manual handling of objects, moving and handling of people. In addition, care staff and catering staff involved with the preparation and serving of food to residents and service users should also complete appropriate food safety and food hygiene courses as part of their mandatory training.
Despite common misconceptions, the Care Certificate is not a compulsory requirement for health and social care providers. However, the Care Certificate standards are based on the core statutory and mandatory training courses for care organisations and it only makes sense to use it as the basis of induction training and additional mandatory training updates and refresher courses.
